POTENTIAL VENDORS

Over 300 concessionaires and commercial vendors can be found all across the fairgrounds. Many of these booths return annually. There are limited booth spaces that open up for new vendors. To be considered as a commercial vendor or concessionaire, you must submit an application with attached pictures of the booth, pictures of items, and brochures (if available).

Please complete and return this application with a picture of the anticipated display or setup and diagram of concession stand, if applicable. No deposit is due with the application. The application must be completely filled out with a signature and picture to be accepted. Please fill in all blanks completely.

With over 250,000 visitors annually, the Eastern Idaho State Fair is southeast Idaho’s largest and longest running event! We are proud to have over 270 commercial vendors and concessionaires who run professional booths with a variety of unique offerings.

Only persons receiving a written license agreement for concession/commercial exhibit space are able to exhibit. These persons must sign the written license agreement and make a monetary deposit with the Manager of the EISF before being allowed to transact any business on
the fairgrounds. Each department will have specific downloadable rules and entry forms.

REFUNDS: No refunds will be made on cancellations after July 31, 2023.

TERMS: All license agreements will expire with the close of the Fair each year. Space not occupied by 9:00 a.m. on the first day of the Fair with no notice given will be resold and no refund made.

NO-SUBLETTING: Licensee agrees not to sub-lease or sub-let any part of the space contracted. The EISF reserves the right to select all concession/commercial vendors.

LICENSE AGREEMENT REVOKED: This license agreement may be revoked by the EISF at any time. Violators of the EISF rules and regulations or any laws of the City, County, State or Federal entities is cause for revocation of the contract privileges automatically and without recovery or relief, and the Licensee agrees to vacate the grounds/location occupied and to cease to do business, without demur and to forfeit all sums paid.

CONCESSIONAIRE PERCENTAGE: All concessionaire percentage payments are due to the Fair no later than September 22nd. Failure to meet the deadline will result in a 21% monthly finance charge and seriously jeopardize being invited back. A daily record of total gross sales must be kept by the Concessionaire and reported on the Concessionaire Percentage Form. The EISF Management reserves the right to request documentation of those gross sales, including daily cash register tapes and Idaho Sales Tax reports for the period of the Fair.

LIABILITY INSURANCE: A certificate of liability insurance naming EISF as an “additional insured” in the amount of $1,000,000 is required against bodily injury and property damage. Where applicable, vendors and concessionaires must also have coverage insuring against product liability and products/completed operations. Your Certificate of Insurance must be on file at the Fair Office by August 1, 2023. Failure to provide a certificate by that date will result in a $115 charge to the total commercial/concessionaire license agreement for coverage under the Fair’s group insurance policy, as long as the activities are not excluded by Haas Wilkerson. Failure to provide a certificate of insurance for vendors excluded by the Haas Wilkerson Policy by the above date will result in a termination of the license agreement, and all Licensee Fees will be forfeited. The certificate of liability insurance must cover the dates of the Fair from September 1 – September 9, 2023, and the dates for set up and tear down. THE Name on THE Insurance Certificate must match THE name on THE license agreement.

INDEMNIFY: It is agreed that the EISF shall not be responsible for any loss, damage, or injury of any character to any property of the Licensee, his or its agents or employees, or for any personal injury suffered by the Licensee, his or its agents or employees with, on, or at the fairgrounds. The Licensee assumes all such risk to person and property. Licensee agrees to indemnify the EISF from any and all liability, loss, or damage the EISF may suffer as a result of claims, demands, and costs of judgments against the EISF arising from Licensee participating in the Fair.

ATTORNEY FEES: The Licensee agrees to pay all attorneys’ fees and costs arising from any dispute over the enforcement or interpretation of this license agreement whether or not a suit is filed.

FORCE MAJEURE: Eastern Idaho State Fair shall not be responsible for cancellation or delay in performance arising out of compliance with any law; ordinance; regulation; ruling order or other governmental actions or arising out of acts of God; fire; flood; unusually severe weather conditions; epidemics; war; acts of terrorism; riot; sabotage; accidents; labor disputes; shortages or failure to supply materials or equipment; interruption of or daily in transportation; or any other similar circumstance beyond the control of the Fair.
